By using our service, you are deemed to have read and accepted the Terms and Conditions set forth below, thereby forming a legally binding agreement between The Creative Partnership Co., Ltd., (owner of the “Creative Gift Décor” brand; and hereafter referred to as “Creative Gift Decor”, “we”, “us”, “our” and their affiliates) and yourself pursuant to which you agree to comply with the Terms of Conditions laid out below. In the case that you not agree with any part of these Terms & Conditions, we advise that you should not use this website.
You may use our service without opening an account with us.
1. Legal Age Requirement
There is no minimum legal age requirement to view this website’s content; however, we do advise that anyone below the age of 18 should obtain parental consent before using our services, and when placing an order / paying for any service. As with any “paid” service it is advisable that parents and guardians supervise their children’s use of the website.
2. Website License, Copyright & Ownership of Content
All software, information, artwork, and other content provided by Creative Gift Decor are protected by copyright and other related laws. You agree that you will not reproduce, modify, disassemble, decompile or derive the source code for the website, publish any analyses or performance benchmark tests relating to the Software or the use thereof. You will have the right to use this website under the condition that you do not change the materials or remove any copyright or other proprietary rights notices in the materials. You may not distribute or copy such material without the written permission of the copyright owner.
3. Links to 3rd Party Websites
Creative Gift Décor may provide links to third party sites that might be of interest to you. We are not responsible for any content in or the availability of these third party sites. It is your responsibility to check and comprehend each site’s privacy policies and the terms and conditions of their service. If you have any concerns with regard to these third party websites please contact direct to the respective site’s webmaster or administrator.
4. Your Content
You may design your canvas through our Online Designer, using JPG or PNG file format that meets our specifications and necessary requirements. Context of design includes without limitation, photographic images and texts, files, works of authorship, illustration and drawings as part of your use of our service.
Under these Terms of Conditions, you agree that you will not use our services for any illegal purposes, and you guarantee that you will NOT use our service for any of the following:
a) Any material that could infringe on the copyright or the rights of publicity and/or privacy of any other party.
b) Any material that can be deemed unlawful, pornographic, defamatory, abusive, threatening, or inappropriate and harmful to children in any way, or could lead to to any civil or criminal liability under applicable law;
c) Any material that contains viruses, worms, corrupt files, Trojan horse or other sort of corrupted codes.
d) Any racist material or material that could promote hatred of any group of people.
It is impossible for us to review all submissions and cannot be responsible for their content, however, Creative Gift Decor reserves the right to refuse to print or delete submitted files that, in our sole opinion, are believed to fall into the categories laid out above in paragraphs (a) through (d) or are otherwise unacceptable. You agree that any submitted file may be printed, copied, adjusted, customized or removed for the purposes of providing our service to you. Additionally you agree that you will be liable for any action (legal or otherwise) taken against Creative Gift Decor in relation to such activities and will fully indemnify Creative Gift Decor against all actions, claims, demands or costs which may arise as a result.
Creative Gift Decor does not guarantee to store your order information including delivery or payment data, and storage for uploaded files is optional as we need to optimize our data storage. Therefore we recommend that you retain a copy for yourself to use for future re-ordering, or in the unlikely event of your digital images being corrupted or lost. It is best to always retain your own copies of all files uploaded or supplied to us by other file transfer systems. Creative Gift Decor has no ownership of any of your content.
5. Order Policy
Receipt of an electronic order or other form of order confirmation does not guarantee Creative Gift Decor’s acceptance of your order, nor does it constitute confirmation of our offer to provide the requested service. Creative Gift Decor reserves the right at any time after receipt of your order, to accept or refuse your order for any reason. We also reserve the right to supply less than the quantity you ordered. Your order is recognized as fully accepted by us upon the delivery of the ordered products. Creative Gift Décor may request additional verifications or information before accepting/processing any order.
6. Fee and Payment Terms
All prices are in Thai Baht and payment must be made with each order. Browsing or accessing the Site is of course fee of charge. Products, prices and services offered are subject to change without prior notice from time to time at our discretion upon posting by Creative Gift Decor on its website(s). For information on our products and prices please refer our product price list.
You hereby agree to pay all fees and charges incurred in connection with your orders which include without limitation taxes, value-added taxes, foreign transaction fee, import duty, and customs clearance, if any. Payment terms will be via online credit/debit card transactions via Paypal, our official payment system, unless otherwise agreed. We reserve the right to refer to your credit card provider. Creative Gift Decor will not be held liable for any losses you may suffer as a result of unauthorized use of your credit card by any other party. An electronic sales order confirmation will be sent to your email address once your order has been received into our system.
Any failure to make a valid payment may result in order delays and/or a refusal to process the requested service(s). When an order with a paid deposit is processed, we will hold the order for a 60 day period, unless otherwise agreed. During this period and until the balance amount is paid in full, Creative Gift Decor may send a notice to the customer’s email address to inform / remind them of their balance due. In the case that the balance is not paid within this 60 day period, Creative Gift Decor reserves the right to charge a handling fee and dispose of any unpaid property. Specifications and prices are subject to change without notice in any circumstances other than when an order has been accepted by us.
In the case of any queries or disputes relating to charges on your credit card, you must inform us in writing (to our email here or Line: @CreativeGiftDecor) within 7 days of receiving your credit card statement. If Creative Gift Decor does not receive payment from your credit card company, you are obliged to pay all amounts due upon demand by Creative Gift Decor.
7. Delivery of Products
We will deliver the finished product(s) to the delivery specified in the order process. Delivery time is an only an estimate and is neither guaranteed nor fixed as part of this agreement. Slow or delayed delivery is not a an acceptable reason for cancellation of your order and you will not be entitled to compensation for delayed delivery. Orders may be refused if we believe that there is any infringement to these Terms of Conditions, and this will, be entirely at the discretion of Creative Gift Decor.
8. Force Majeure
Creative Gift Decor will not be liable for non-completion or delayed completion of our service caused by any extraordinary event or circumstance beyond our control including, without limitation, a contagious virus that severely interferes with normal business activity, wars, strikes, riots, hostilities, revolutions, national emergency, explosion, civil commotion, embargo, fire, flood, earthquake, volcanic eruption, and force of nature or any “acts of God”.
9. Satisfaction Guarantee & Product Warranty
Creative Gift Decor is proud of the excellent quality and craftsmanship of our products, and provides 100% Satisfaction Guarantee* against any manufacturing defects. Refunds and cancellations of an order are generally not provided except for cases of a product processing error or product malfunction (i.e. poor or defective processing/workmanship, product arrives damaged, product does not match ordered items). Creative Gift Decor reserves the right at any time to substitute or change the brand or exact type of materials used in production of your canvas without prior notice. In cases of material shortage, we will substitute by using the next best alternative material of the closest quality and specification.
As the canvases are assembled by hand, the end result may differ from our website images. Creative Gift Decor also reserves the right to change any production method without prior notice. These may or may not result in a slight difference in the product’s final appearance or slight color changes, while maintaining the same quality and standards.
IMPORTANT: We do NOT accept any amendments or changes to be made to the file ONCE the file is already uploaded. Therefore, it is solely the responsibility of the customer to check their file(s) thoroughly before ordering product(s).
Creative Gift Decor is not culpable for mistakes, errors or defects generated by customers, including spelling, typographical or grammar errors, poor image quality derived from low-resolution images, all imperfections within the files (including poor colour and light balance), order the wrong quantity or other ordering errors. Please preview your artwork with great care before placing your order. Images and text will be printed as they appear in the Preview. As part of our normal service we do not check for, adjust or correct such customer generated mistakes, nor do we proofread clients work to identify any errors.
In order to make a complaint, please email our customer service team including with picture of the problem/areas of dissatisfaction. We will assess the quality / condition of the product(s), and it will be at our sole discretion to either repair or replace the product(s) that does not meet the warranty or condition. All complaints on defective product(s) must be submitted within 15 days upon receiving your product(s).
10. Acceptance of Agreement
YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS. Creative Gift Decor reserves the right, at our sole discretion, to update or make modifications to this Terms of Service from time to time without prior notice.
